Nebraska Sports Betting

Sports betting is legal in Nebraska, but mobile apps are not available at this time. Right now sports betting is only available at a handful of retail sportsbooks in the state. The legislature approved sports betting in 2021 with the passing of LB 561, but mobile betting apps remain elusive.

Where Can You Bet in Person in Nebraska?

Five licensed racetrack casinos operate sportsbooks. A sixth, WarHorse South Sioux City, broke ground on August 27, 2026 and has no opening date.

Counters at both WarHorse properties run from late morning to 9 or 10pm, and kiosks there take wagers 24 hours. Harrah's Columbus is closed Monday and Tuesday, with kiosks running 8am to 3am. Grand Island and Lake Mac do not publish counter hours; call ahead.

What it generates. Nebraska taxes gross gaming revenue at 20%, with 70% of that going to property tax relief. Sports betting is a rounding error inside it: about $9.3 million in gross gaming revenue in 2025, nearly double the prior year, against $261.9 million for Nebraska casino gaming overall. The ballot campaign projects roughly $87 million over five years from online betting, implying a market several times the current retail one.

No tribal casino in Nebraska takes sports bets. Ohiya, Iron Horse, Native Star and Lucky 77 run Class II bingo-based gaming with no Class III compact. Prairie Flower Casino has a sportsbook, but it sits in Carter Lake, Iowa, under Iowa law.

How to Place a Bet at a Nebraska Sportsbook

Bring a government photo ID; you will be asked for it over $3,000 and can be asked at any point. At the counter, give the ticket writer the rotation number of the game, the bet type, the side and the amount, then check the printed ticket before you leave the window because it is a bearer instrument and the counter will not fix it afterward. At a kiosk you build the same bet on screen and feed in cash. Kiosks at both WarHorse properties run 24 hours even when the counter is closed.

Retail books are cash-forward. Kiosks take cash and pay out tickets under a set threshold in cash, with larger wins settled at the counter. Winning tickets expire, and at WarHorse the window is 60 days. Keep the paper.

If the WarHorse app will not let you place a bet while you are standing inside the casino, that is expected rather than broken: the app builds and saves a bet slip, and the wager still has to be placed at a counter or kiosk.

Is There a Nebraska Sports Betting App, and What Is on the November Ballot?

There is no legal Nebraska sports betting app. The WarHorse app lets you build and save a bet slip in advance, but the wager still has to be placed in person.

The reason is constitutional, and it is narrow. Article III, Section 24 bars the Legislature from authorizing games of chance, with a 2020 carve-out that applies only to gaming conducted “within a licensed racetrack enclosure.” A bettor on a couch in Kearney is not inside a racetrack enclosure, so no ordinary statute can reach them regardless of the vote margin. Sen. Eliot Bostar’s LR 20CA cleared first-round debate 27-16 in April 2025, then stalled short of the 33 votes needed to break a filibuster, and died at sine die on April 17, 2026.

The 2026 ballot measures go around the Legislature entirely:

Both need a simple majority and affirmative votes exceeding 35% of all ballots cast, Nebraska’s rule against measures carried by an undervote. The campaign committee, Tax Relief Nebraska, has raised over $5 million, with roughly $3.5 million each from FanDuel and DraftKings plus money from Fanatics and BetMGM. Attorney General Mike Hilgers opposes expanding gambling in Nebraska. Gov. Jim Pillen personally opposes gambling while acknowledging the tax revenue argument for legalizing online betting.

Official measure numbers had not been assigned as of August 27; final ballot certification is due September 11, 2026. Do not expect a live app this year. June 1, 2027 is the deadline for the Commission to write regulations, and betting would follow some time after that.

Can I Cross Into Iowa and Bet on My Phone?

Yes, and it is legal. Iowa has full statewide mobile betting, allows remote registration, and does not care where you live. Only where you are standing at the moment the wager is accepted matters.

Set the account up at home in Nebraska. Iowa dropped its in-person registration requirement on January 1, 2021, so you can download an app, verify your identity and deposit from your kitchen table. Have a government photo ID and your Social Security number ready; a Nebraska residential address is fine, and your name and date of birth have to match your ID exactly or the check kicks to manual review, which takes hours. The Iowa Racing and Gaming Commission lists 13 licensed online sportsbook operators.

You must be 21, in Iowa and in Nebraska, and residency is irrelevant on both sides of the line. Iowa does not care that you live in Nebraska, only where you are standing. Nebraska does not care that you live here either: an out-of-state visitor who is 21 can bet at a Nebraska sportsbook, and a Nebraska resident still cannot bet from home. How Geolocation Behaves on the Bridges

Geolocation does not simply check which state you are in. Iowa’s rule requires that a bettor outside the permitted boundary be rejected, and that “the confidence radius shall be entirely located within the permitted boundary.”

Geolocation does not return a point. It returns a point plus an uncertainty circle, and the whole circle has to fit inside Iowa. If your fix is 40 meters into Iowa with a 100-meter confidence radius, you get rejected, not because the system thinks you are in Nebraska but because it cannot rule Nebraska out. 

A Missouri River bridge is close to the worst place you could try. There is no Wi-Fi over open water, which removes the most precise input available in a dense area. Steel and cable structures degrade GPS through multipath. Cell tower fallback in a river corridor straddles two states by construction, and GeoComply’s own example has tower-only data pushing the effective buffer to as much as three miles. One licensed operator’s own help center puts it plainly: within half a mile of a border “you may be blocked from play and will need to move further away.”

What actually works: cross, keep driving, and stop at least half a mile past the line, preferably one to two miles, somewhere with buildings and Wi-Fi around you. A Council Bluffs parking lot, not a shoulder. Walking to the marker on the Bob Kerrey bridge will not work; walking the whole way to Tom Hanafan River’s Edge Park will.

The Carter Lake Trap

Carter Lake is legally Iowa but sits west of the Missouri River, wedged inside Omaha, a quirk of an 1877 ice jam that the Supreme Court declined to fix in 1892. Abbott Drive, the airport road, passes through it. That makes it the only Iowa soil reachable from downtown Omaha without crossing a bridge, and Prairie Flower Casino is there.

It is also 1.87 square miles. A device near the center sits well under a mile from Nebraska in some direction, and the Abbott Drive segment is a 0.4-mile ribbon with Nebraska at both ends. Against the half-mile buffer operators warn about, that is marginal. Treat Carter Lake as a place a bet may fail, not a reliable spot.

What Happens When You Drive Home

Your bets settle normally. If the wager was placed in Iowa with an Iowa licensee, you're good. Winnings post to your account while you are in Omaha.

What you cannot do from Nebraska is anything that constitutes placing a wager: new bets, live in-play bets, and cash-out, which is a fresh transaction against an open position. Logging in, checking your account, depositing and withdrawing to a Nebraska bank generally still work.

Which Border Is Nearest From the Rest of Nebraska?

South Dakota is not an option. Its betting is retail-only, at Deadwood casinos in the western Black Hills and at tribal casinos in Sisseton and Watertown in the far northeast. Deadwood is roughly 110 to 120 miles from the Nebraska line, the tribal properties several hundred, and none of it is mobile. The South Dakota House rejected a 2026 measure that would have put mobile on the November ballot.

What Do Nebraskans Owe in Tax on Iowa Winnings?

Nebraska taxes residents on their entire federal adjusted gross income, “even if some of it has been earned for services performed outside Nebraska.” Iowa winnings are Nebraska income, full stop. Iowa taxes them too, as nonresident Iowa-source income. You get a credit, so you are not taxed twice.

Nebraska’s 2026 top rate is 4.55%, down from 5.20%, falling to 3.99% in 2027. Iowa is a 3.8% flat tax.

Losses are where people get hurt. They are deductible only as a federal itemized deduction, and Nebraska’s return starts from the federal number. Take the federal standard deduction and you deduct nothing federally, nothing in Nebraska, and pay tax on 100% of gross winnings. Since 2026, federal law also caps the deduction at 90% of losses, so even an itemizer reports income they never had.

A worked example. An Omaha single filer, $85,000 in wages, who wins $60,000 and loses $52,000 betting on Iowa apps. Real profit: $8,000. He also has $5,500 of state and local income tax and $2,500 of property tax on federal Schedule A, which is what makes itemizing worth it.

The two are identical. The credit does exactly what it is designed to do: crossing into Iowa costs nothing in extra state tax. It costs paperwork, and one surprise.

The surprise: on a $50 parlay that paid $25,000, Iowa withheld about $948 but he owed Iowa $1,418. Withholding under-covered the liability and he writes Iowa a check for $470. Most people assume the opposite.

And for nearly everyone, nothing is withheld at all. Iowa began withholding on sports wagering January 1, 2026, but only where federal withholding applies, which requires a payout over $5,000 net of stake and at least 300 times the wager. Ordinary sides, totals and small parlays never come close. You will owe tax with nothing set aside against it.

Three practical notes. Nebraska’s credit is claimed on Schedule II, not Schedule I, and it must be built on the Iowa tax you actually owed, not the amount withheld. A complete copy of the Iowa return has to be attached or the credit is disallowed. And $1,000 or more of Iowa-source income generally triggers a mandatory Iowa return, which is a low bar for anyone betting seriously.

Can You Bet on the Cornhuskers?

Yes, sometimes. The common claim that Nebraska college teams are entirely off-limits is not correct. Three separate prohibitions apply:

So you can bet a Cornhuskers road or neutral-site game pregame. You cannot bet any home game, cannot bet a player prop on a Nebraska college athlete anywhere, and cannot bet live on any Nebraska college game anywhere.

“Nebraska college or university team” covers every in-state school, not just Lincoln. Creighton basketball is the most practically affected after football. Futures markets are not addressed by any of the three rules and books differ, so ask before assuming.

Also prohibited statewide: high school and youth events, minor-league sports, injury wagers, and fantasy contests at licensed sportsbooks. WarHorse allows parlays up to 20 legs with a $5 minimum, a $10,000 maximum per bet and a $50,000 payout cap.

Why Won’t My Betting App Work in Nebraska?

Because you are in Nebraska. Your account is fine.

Your account travels with you, but the catalog loads on where you are standing, and no sportsbook accepts a wager placed from inside Nebraska. DraftKings and FanDuel both run fantasy products here; their sportsbooks do not operate in the state and cannot.

A VPN does not solve this. Geolocation does not rely on IP address alone, so spoofing usually fails outright, and any VPN or remote-desktop software running will hard-block the check regardless. It is a terms violation at every licensed book, and the standard consequence is a voided balance. It also does not change the legality of the bet.

Offshore books are illegal and winnings may be unrecoverable. Nebraska has no standalone offense for placing a bet; a player is charged under the promoting gambling statutes, and betting under $500 in a day is a Class IV misdemeanor with a $500 maximum fine and no jail. At $500 or more in a day it becomes a Class II misdemeanor carrying up to six months. Enforcement against individual bettors is effectively nonexistent. The real exposure is financial: an offshore wagering contract is unenforceable, no Nebraska agency licenses or bonds these operators, and there is no route to recover a balance an offshore book refuses to pay.
