Oklahoma Sports Betting

Sports betting in Oklahoma is not a question of finding 51% of the legislature. It is a question of renegotiating an agreement between the State of Oklahoma and 35 sovereign tribal nations, and the two sides do not agree on what the new arrangement should look like.

How Oklahoma’s Gaming Compact Works

Tribal gaming operates under the State-Tribal Gaming Act, passed in November 2004, which contains a Model Tribal Gaming Compact. Tribes that adopt it may offer specified categories of gaming. In exchange they pay the state exclusivity fees, and the state agrees to protect that exclusivity.

The financial terms, as described by Oklahoma Indian Gaming Association chairman Matthew Morgan to a Senate interim study in October 2025:

Sports betting is not among the authorized categories. Adding it means amending the compact, and Morgan told the committee that failure to comply could expose the state to monetary damages.

What House Bill 1047 Proposed

The version that reached the Senate floor was not the bill as introduced. Sen. Bill Coleman filed a substitute by floor amendment on April 21, 2026, after what he described as thousands of hours of negotiation. It carried the support of the Oklahoma City Thunder, the state’s leading public universities and, with one exception, the tribes.

The structure:

• Sports betting authorized through a supplement to the Model Gaming Compact rather than a commercial licensing regime.
• Both in-person wagering at tribal facilities and statewide mobile.
• Tribes retain exclusive rights to offer gaming and may negotiate partnerships with national platforms such as FanDuel and DraftKings, which would operate through those tribal partnerships.
• Tribes remit 8% of the adjusted transactional total to the state as exclusivity fees.

Where the money would have gone:

That last provision was a revenue-sharing mechanism designed so smaller tribes without the scale to run a sportsbook would still benefit, an attempt to hold a 35-nation coalition together.

What it was projected to be worth:

• Coleman estimated $15 million to $18 million a year in state revenue from the 8% fee.
• FanDuel put the figure at $75 million to $100 million over five years.
• The Sports Betting Alliance told the October 2025 interim study that states with legal sports betting tax it at an average of around 16%, roughly double what HB 1047 proposed.
• The Thunder, through vice president of corporate partnerships Will Syring, sought 0.25% of total wagers, on the basis that teams in other markets receive direct licenses and are paid off handle.

Why HB 1047 Failed

Two things went wrong in the final 48 hours, and neither was the moral objection that dominated the floor debate.

The Cherokee Nation objected to how mobile bets would be geographically allocated. According to House author Ken Luttrell, every member of the Oklahoma Indian Gaming Association except the Cherokee Nation supported the bill. The objection concerned the way the amendment prescribed tribal boundaries for mobile wagers, meaning which nation a bet placed anywhere in the state would be attributed to.

The voting pattern reflects it. Seven of the Senate’s eleven Tulsa County members voted against, as did other senators representing northeast Oklahoma, which is Cherokee Nation territory. Sen. Regina Goodwin of Tulsa pressed the point on the floor.

Late opposition from the Southern Baptist Association, announced shortly before the vote. Combined with the boundary dispute, it was enough.

Almost none of the floor debate concerned tribal jurisdiction. It was about the ethics of the state taking revenue from gambling losses.

• “The role of the government is to protect life, liberty and property, not to normalize addiction and to prey on weaknesses and build revenue streams off of citizens’ losses. When the state sanctions that, it’s no longer neutral. The state becomes a participant in a moral hazard.” — Sen. Dusty Deevers (R-Elgin)
• “I taught 190-plus kids every single year. I never once taught a kid that I had the thought, ‘I wish that kid’s parents would gamble just a little bit more.’” — Sen. David Bullard (R-Durant), on the argument that betting revenue would fund literacy programs

Coleman’s counter-argument was that the activity is already happening in Oklahoma, legally, through prediction markets, and the state gets nothing from it.

You can legally make that bet right here in Oklahoma right now, on this floor, and we don’t get a dime out of it, and they’ve got no laws. This is not increasing gambling alternatives in Oklahoma. It is providing a regulated industry to operate sports betting with our tribes versus the predictions market and the black market.” — Sen. Bill Coleman (R-Ponca City), Senate floor, April 22, 2026

Why 21-27 Understates the Problem

The bill needed 25 votes to pass the Senate and got 21. But passage was never the real threshold.

Gov. Kevin Stitt had already signaled a veto. Spokesperson Tevis Hillis said the day before the vote that the governor “is not interested in expanding Democrat Gov. Brad Henry’s bad gaming compact that lacks transparency and fair market rates.”

Overriding a veto in the Oklahoma Senate takes 32 votes. Supporters were eleven votes short of the number that mattered, not four.

Coleman formally captured the vote afterward, preserving the option of reconsideration, but the motion expired on April 28, 2026. Half an hour after the vote he was candid that picking up four votes was unlikely and seven more beyond that unrealistic.

What Happens Next

Nothing before the 2027 session, and the biggest variable is not in the legislature.

Stitt is term-limited and Oklahoma elects a new governor in November 2026. One of the two parties to the compact negotiation is changing. Coleman said as much on the day of the vote: “try again next year,” adding that “tribal relations might be better next year.”

The Cherokee Nation’s boundary objection is a drafting problem rather than an objection in principle, which is more tractable than a philosophical split. The House has now passed sports betting legislation twice by comfortable margins; the Senate remains the obstacle. The moral objection is unlikely to soften, though its most prominent advocate, Sen. Dusty Deevers, lost his primary in June 2026.

How Big Is Oklahoma Tribal Gaming?

Large enough that it explains the politics. Oklahoma is the largest tribal gaming market in the United States by facility count, and the two National Indian Gaming Commission regions covering the state generated a combined $7.3 billion in gross gaming revenue in fiscal year 2025.

The national figure covers 545 gaming operations run by 246 tribes across 29 states, based on audited financial statements. Seven of the NIGC’s eight regions grew year on year.

Two caveats. The Oklahoma City region includes Texas and the Tulsa region includes Kansas, so the $7.3 billion is not purely Oklahoma. And revenue is not facility count: California generates more from fewer, larger properties. What the numbers establish is scale, and scale is why a compact renegotiation in Oklahoma is a bigger undertaking than in almost any other state.

Where Can an Oklahoma Resident Legally Bet?

Kansas and Arkansas, which work differently from each other. Missouri and Colorado also offer legal betting, New Mexico has tribal casino sportsbooks only, and Texas has nothing.

The college catch runs opposite to expectation. In Kansas you can bet Oklahoma and Oklahoma State, because they are out-of-state teams from a Kansas perspective, but you cannot bet college player props, which Kansas prohibits statewide regardless of team. Arkansas has no college restrictions at all. So Sooners and Cowboys player props are available in Arkansas and not in Kansas.

Which border is nearest:

• Oklahoma City. Kansas, directly north on I-35. Statewide mobile means you do not need to reach a casino.
• Tulsa. A genuine choice. Arkansas City, Kansas is around 118 miles by road; Arkansas is east and allows unrestricted college betting.
• Lawton and southwest Oklahoma. The worst-placed metro in the state. Texas is immediately south and offers nothing, Kansas is a long drive north, Arkansas further east. A border trip from Lawton is a day out.

For most Oklahomans the sensible arrangement is to open a Kansas account, keep it open, and use it when traveling north. Driving specifically to place a recreational bet rarely makes financial sense: a round trip from Tulsa to the Kansas line is roughly 236 miles, which costs more in gas than a $25 wager can plausibly return.

Your account, balance and open bets are unaffected by driving home. Bets already placed settle normally and you can withdraw from Oklahoma. You simply cannot place new ones.

Taxes on Out-of-State Betting Winnings for Oklahoma Residents

Oklahoma taxes gambling winnings as ordinary income, including winnings from bets placed in Kansas or Arkansas, using six graduated brackets with a top rate of 4.75%. Kansas also taxes the income as a nonresident, and Oklahoma credits you for tax paid to Kansas up to what Oklahoma would have charged.

Oklahoma just made gambling losses more deductible, against the federal trend. Oklahoma caps itemized deductions at $17,000. Wagering losses were originally caught by that cap, which meant a high-volume bettor could owe state tax on winnings they had not kept. The legislature passed a bill excluding wagering losses from the cap beginning with tax year 2025, the governor vetoed it, and the legislature overrode the veto.

That runs opposite to federal law, where from January 1, 2026 gambling losses are deductible at only 90% of their value. The federal W-2G reporting threshold is now $2,000, and 24% withholding applies where winnings exceed $5,000 net of the stake and pay at least 300 to 1.

Two things that catch people out in either jurisdiction: you report gross winnings rather than net profit, and you get a loss deduction only if you itemize. Most filers take the standard deduction and get none.

This is general information rather than tax advice, and multi-state filing gets complicated quickly.

Betting on the Thunder, OU and Oklahoma State

You cannot bet on any of these teams from Oklahoma. All three are bettable in Kansas, Arkansas, Missouri and Colorado, subject to each state’s college rules.

The Oklahoma City Thunder won the 2025 NBA championship, beating Indiana in seven games, then posted the best record in the league in 2025-26 at 64-18 before losing the Western Conference finals in seven to San Antonio. Shai Gilgeous-Alexander is a two-time MVP. No neighboring state restricts NBA betting.

Oklahoma went 10-3 in 2025, 6-2 in the SEC, and lost 34-24 to Alabama in the College Football Playoff first round. Brent Venables is in his fifth season. Oklahoma State competes in the Big 12 at Boone Pickens Stadium.

Bedlam is bettable as a game in both Kansas and Arkansas. Player props on either team are available only in Arkansas.

If I Live in Oklahoma but Bet in Kansas, How Do I Self-Exclude There?

You enroll in the program of the state where you bet, and residency is not a barrier.

• Kansas runs its own self-exclusion program covering Kansas-licensed sportsbooks. An Oklahoma resident can enroll.
• Enrolling in one state does not carry to another. If you bet in Kansas and Arkansas, you enroll separately in each.
• Every licensed operator also offers account-level deposit limits, wagering limits and self-exclusion. These work immediately, from anywhere, including from inside Oklahoma. If you need to act today, that is the fastest route.
• Oklahoma tribal casinos run their own exclusion programs through tribal gaming commissions, separate again.

There is no single list covering an Oklahoma bettor. Someone who plays at an Oklahoma casino and bets on a Kansas app is dealing with two systems that do not talk to each other.

Offshore Sportsbooks and Daily Fantasy in Oklahoma

Offshore sportsbooks hold no US license, are not permitted to serve Oklahoma residents, and offer no recourse. If one refuses to pay, freezes your balance or disappears, there is no regulator to complain to and no requirement that it held your funds separately from its own. Any site that accepts a wager from you while you are in Oklahoma is operating outside the regulated market, and that alone is the test.

Daily fantasy platforms serve Oklahoma in the absence of an explicit prohibition rather than under a state license. No regulatory framework has been established, so the consumer protections that come with regulation do not apply.
