Is Sports Betting Legal in West Virginia?
Yes. Senate Bill 415 created the West Virginia Lottery Sports Wagering Act and took effect on March 3, 2018. The law was already in place when the U.S. Supreme Court struck down the federal PASPA ban that May, allowing West Virginia to move quickly once states were free to offer legal sports betting.
The West Virginia State Lottery Commission regulates the market and publishes its current Sports Wagering License List. State law authorizes wagering through the four licensed racetrack casinos and the state's historic resort hotel, with approved mobile platforms operating through those gaming facilities.

West Virginia also has retail sports betting. The five casino properties authorized under the state's sportsbook model are Hollywood Casino at Charles Town Races, The Greenbrier, Mountaineer Casino Racetrack & Resort, Mardi Gras Casino & Resort and Wheeling Island Hotel-Casino-Racetrack. West Virginia sports betting taxes
Sportsbook winnings are taxable federally and in West Virginia. Report gross gambling winnings, not just your final profit. West Virginia's 2026 individual income-tax rates range from 2.11% to 4.58%.
For federal taxes, gambling losses are deductible only if you itemize, and the 2026 deduction is capped at 90% of your losses or your winnings, whichever is lower. If you win $10,000 and lose $10,000, you still report $10,000 in winnings and can deduct no more than $9,000 federally.
West Virginia kept its own treatment under SB 400, allowing qualifying state gambling losses up to the amount of West Virginia gambling winnings. Pennsylvania and Virginia handle losses differently, so keep records by state if you bet across the border.
Lastly, the general 2026 W-2G threshold is $2,000, with additional rules for sports wagers. Taxable winnings still have to be reported even if you don’t receive a W-2G.
