When Montana legalized sports betting through House Bill 725 in 2019, lawmakers handed the whole market to the Montana Lottery. They never created licenses for private operators. The Lottery runs one sportsbook, Sports Bet Montana, and it has no competitors.

So DraftKings and FanDuel are not shut out by a rule. There's simply no license for them to apply for.

Open a national sportsbook app in Billings or Bozeman and you'll see one of three things: The app says it's unavailable in your location. Or it loads with sports betting stripped out. Or it lets you deposit money but never lets you place a bet. All three mean the same thing.

Montana also banned real-money daily fantasy sports in that same 2019 law. So DFS contests are off the table too.

Which betting apps actually work in Montana?

Take the week ending August 29, 2026. Statewide handle hit $1,014,936 and the Lottery paid $30,448 in sales agent commissions. That lands almost exactly on 3%.

Spread across 550-plus venues, that averages about $55 for the week. Averages hide a lot here. A busy Billings bar during football season will clear many times what a rural tavern makes in February.

Two things worth knowing before you apply. Montana sports betting is seasonal and small in absolute terms, with statewide handle of about $66 million across the whole venue network in Fiscal Year 2025. And the compliance work is real. You handle age verification at 18, responsible gambling signage, self-exclusion and record-keeping.

Yes. Montana legalized sports betting when Governor Bullock signed House Bill 725 on May 3, 2019, and bets have been legal since March 2020. You can only bet through Sports Bet Montana, and only while standing inside a licensed venue.

Montana moved fast after the Supreme Court struck down PASPA in May 2018. The legislature passed two competing bills that session. HB 725 gave the market to the Montana Lottery. SB 330 would have licensed commercial operators instead. Bullock signed the Lottery model, and no commercial sportsbook has ever launched here.

Who regulates it

The Montana Lottery both runs and regulates sports betting. Every other form of gambling in the state answers to a different agency.

So a question about a bet goes to the Lottery. A question about a venue's gambling license goes to the Gambling Control Division.

What changed recently

• October 1, 2025. Senate Bill 555 took effect. Montana became the first state to explicitly ban dual-currency sweepstakes casinos and social sportsbooks that pay real cash prizes. Penalties reach $50,000 and 10 years. Free-to-play apps with no cash redemption are still fine.
• April 2026. Prediction market operator Kalshi sued the Montana Attorney General in federal court after the state issued cease-and-desist orders over its sports event contracts. The case restarted on August 27, 2026.
• August 28, 2026. The Ninth Circuit, which covers Montana, ruled 3-0 in KalshiEX, LLC v. Assad that sports event contracts are not "swaps" under the Commodity Exchange Act. It also held that federal law doesn't preempt state gambling regulation. That clashes with an April 2026 Third Circuit ruling, and most observers expect the Supreme Court to settle it.

No bill legalizing statewide mobile sports betting has passed. Any change needs new legislation.

Who Can Bet in Montana

You need to be 18+, standing inside a licensed Montana venue, and able to verify who you are. You don't need to live here.

The venue's liquor license may still control who gets through the door, so a bar's own policy can be stricter than the betting rule.

Can you bet on the Grizzlies and Bobcats in Montana?

Yes. Montana doesn't ban betting on in-state college teams, so you can wager on the University of Montana and Montana State wherever Sports Bet Montana posts a market.

You'll usually find Grizzlies and Bobcats games, especially the Brawl of the Wild and FCS playoff games. You'll find fewer bet types than you would on an SEC or Big Ten game. And smaller Olympic sports at either school often have no market at all.

Taxes on Montana Betting Winnings

Montana taxes your betting winnings, and so does the IRS. Montana has a state income tax, and treats gambling winnings as ordinary income.

Montana State Tax for 2026

House Bill 337 passed in the 2025 session and changed the brackets on January 1, 2026. The top rate dropped from 5.9% to 5.65%, and it falls again to 5.4% in 2027.

Federal Tax for 2026

The IRS treats winnings as ordinary income and taxes them at your marginal rate, somewhere between 10% and 37%.

Two federal changes for 2026:

• The Form W-2G reporting threshold rose to $2,000. You will get fewer forms. You still owe tax on everything you win.
• You can now deduct only 90% of your losses, and only if you itemize. Break even across a year and you can still owe federal tax.

What You Actually Keep

Say you are a single filer in Missoula with $60,000 in taxable income from work. You finish 2026 up $5,000 net on Sports Bet Montana.

That works out to roughly 27.7% on the winnings. Earn less overall and you may land in a lower federal bracket and Montana's 4.7% band, so you would keep more.

How Montana Compares to its Neighbors on Tax

Montana taxes betting winnings more heavily than every neighboring state that allows betting at all.

IMPORTANT: Montana taxes its residents on income wherever they earn it. Drive to Wyoming, win there, and you still report it in Montana. You may get a credit for tax paid to another state, but Wyoming charges none, so there is nothing to credit.

Are offshore books and prediction markets legal in Montana?

The practical risk is not arrest. It's that no Montana authority can force an offshore book to pay you if it voids a winning bet or stops responding. The regulated system offers segregated funds, a complaints route, integrity monitoring and enforceable self-exclusion.

Prediction markets. Kalshi, Polymarket and similar platforms sell "event contracts" on sports outcomes, arguing they're federally regulated derivatives under the Commodity Exchange Act rather than gambling.

Montana disagreed and issued cease-and-desist orders. Kalshi sued the Montana Attorney General in April 2026, and the case restarted on August 27, 2026.

A day later, the Ninth Circuit ruled against Kalshi in KalshiEX, LLC v. Assad, holding that sports event contracts aren't swaps and that federal law does not preempt state gambling regulation. That court covers Montana. The decision contradicts an April 2026 Third Circuit ruling and will likely reach the Supreme Court.

As of September 09, 2026, Kalshi isn't available in Montana. Given how fast this is moving, check any platform's current Montana status directly.

Montana Sports Betting Common Problems and How to Fix Them

The app says you are not in a valid location, but you are standing in the bar. This is the most common Sports Bet Montana problem. Geolocation checks whether you are inside a licensed venue, which is a much tighter perimeter than a state border. Do this:

1. Turn on location services and set them to "precise" for the app.
2. Turn off any VPN completely.
3. Switch from Wi-Fi to cellular, or the other way around.
4. Move away from exterior walls, and out of basements or metal-framed rooms.
5. Close and reopen the app to force a fresh check.

• The kiosk won't take your bet. Check your balance first, then your stake, since the Lottery caps how much you can wager. If neither is the problem, the market probably closed at kickoff or got suspended during an injury stoppage. The error message usually tells you which. 

• The bet type you want isn't there. Every kiosk in Montana runs the same book, so if the market doesn't exist, another venue won't help. If the kiosk itself is playing up, ask the staff.

• Your payout hasn't arrived. Sales agents can only pay out $600 or less. Anything bigger goes through the Montana Lottery, by mail or in person in Helena. If an account withdrawal is still missing after five business days, reach out to the Montana Lottery.

• Your account is suspended. Sports Bet Montana switches off accounts after 18 months of inactivity. Call support and they'll reactivate it.

• Nothing works after you crossed a state line. Sports Bet Montana only runs inside licensed Montana venues. 

How Montana Sports Betting Compares to its Neighbors

Montana is the most restrictive neighbor that allows sports betting at all. Wyoming has a similarly small population, legalized around the same time, and also lets 18-year-olds bet. Yet it runs full statewide mobile betting with competing operators.

So the practical takeaway is this. Better pricing sits an hour's drive away in Wyoming or Colorado, and betting there is legal as long as you're physically in that state. Check the current rules with each state's regulator before you count on it.
