Who regulates sports betting in North Dakota?

No single government or regulatory body for the state of North Dakota does. But the tribes do have their own individual gaming commissions. These commissions set and enforce the rules that govern tribal sports betting inside North Dakota, under oversight from the National Indian Gaming Commission.

If you have a problem with a bet at a North Dakota tribal sportsbook, you take it to that nation's gaming commission, not to a state agency.

4. At a staffed window, say it in this order: the rotation number, the bet type, the amount. For example, "371, Vikings minus three and a half, fifty dollars."
5. Check the ticket before you leave the window. Teams, bet type, line, amount and payout.
6. Keep the ticket somewhere safe. It is a bearer instrument, so whoever holds it can cash it. The paper is what pays.
7. Cash winning tickets at the same property. A ticket from one North Dakota tribal sportsbook cannot be redeemed at a different nation's casino.

• E-wallets such as PayPal or Venmo cannot be used at a retail sportsbook counter, because there is no account to fund. These are online betting tools and there is no legal online sportsbook in North Dakota to use them with.

Payouts are in cash at the window for most amounts. Large wins may be paid by check and will trigger federal tax reporting.

How are North Dakota betting winnings taxed?

North Dakota has a state income tax, so both a federal and a state obligation apply, and 2026 is the year the federal rules got worse for bettors.

You report gross winnings, not net profit. Every winning wager is income. Losing wagers are a separate itemized deduction, not a subtraction. A year in which your winning bets totaled $6,000 and your losing bets totaled $6,400 is not a $400 loss for tax purposes; it is $6,000 of income against a deduction you may not be able to use.

You only get the loss deduction if you itemize federally. Most filers do not. And in North Dakota this bites harder than in most states, because the North Dakota individual return is built directly off your federal return.

There is no separate state schedule for gambling losses, so if you take the federal standard deduction, you get no loss offset federally and none in North Dakota either. You are taxed on the gross figure in both places.

What changed federally for 2026?

• Gambling losses are now deductible at only 90 percent of their value, still capped at the amount of your winnings, for tax years beginning January 1, 2026. The previous rule allowed 100 percent up to winnings. The practical effect is that a break-even or losing year can generate taxable income.

• The information reporting threshold for gambling payouts rose from $600 to $2,000 for payments made after December 31, 2025, indexed for inflation thereafter. Fewer W-2G forms get issued, which does not change what you owe, only what is reported for you.

What North Dakota adds

Not much, and that is the good news. North Dakota's individual income tax runs on three rates:

• 0 percent
• 1.95 percent
• 2.50 percent

These were decided following the 2023 reform. The zero bracket covers the first set of taxable income, with thresholds adjusted annually by the Office of State Tax Commissioner, and the top rate of 2.50 percent is among the lowest of any state that taxes income.

What forms you will receive at a tribal casino

A tribal sportsbook issues federal forms exactly as any other payer does.

A W-2G is generated when a payout meets the federal reporting threshold, and 24 percent federal withholding applies to certain large payouts.

Tribal nations do not withhold state income tax on your behalf, so a North Dakota resident is responsible for reporting winnings on their own state return. The absence of a form never means the absence of an obligation.

You can self-exclude from gambling in North Dakota, but it has some gaps in the program, primarily because it is not a statewide program.

Each tribal casino operates its own voluntary exclusion list. Excluding yourself at one property does not exclude you at the other properties, or at prediction market exchanges. If you are excluding, you have to do it at every property individually.

All prediction markets have limits that can be used to help players, with the likes of Kalshi and Polymarket offering:

• Deposit limits: how much you can deposit in a set period of time

• Wagering limits: how much you can spend in a set period of time

• Reality checks: a reminder if you have been playing for a lengthy period of time

• Time-outs: the site will lock you out for a set number of hours, days, or weeks

• Site self-exclusion: permanent exclusion from being able to use their services
